In plain terms
Who the child lives with, how much support is paid monthly, and when the other parent visits can be mutually negotiated into the agreement. If you cannot agree, the court decides: for parents with fixed incomes, support is generally set at 20% to 30% of monthly income. If agreed support is not paid, you can sue and execute against bank accounts. If the custodial parent obstructs visitation, courts can fine or detain them, but will never physically force a child into visits against their will.

Cost: what it takes
Zero financial fee when incorporated into an uncontested divorce agreement. The real challenge is sitting down with an ex-partner to negotiate specific mechanics: exact calendar dates of monthly remittance, designated payee bank accounts, alternating weekend pickup and return hours, and splits of summer and winter school vacations. If negotiations stall, contested court litigation is required. Divorce court filing fees range from 50 to 300 RMB per case; attorney fees are borne personally and cannot be shifted to the opposing party. First-instance ordinary procedure takes at least 6 months with potential extensions, while summary procedure takes 3 months. Post-divorce child support or visitation enforcement actions require separate lawsuits.
Benefit: what the source reports
The Civil Code stipulates that the amount and duration of child support and the method and schedule of visitation shall first be negotiated by both parents; if negotiations fail, the court adjudicates. For children under 2 years of age, custody is awarded to the mother in principle. For children aged 2 and older, custody is decided based on the principle of the "best interests of the minor child." For children aged 8 and older, their genuine personal wishes must be respected. Effective February 2025, if one party has committed domestic violence, gambling, drug abuse, extramarital cohabitation, or child snatching and concealment, the court gives priority to awarding custody to the other party. Child support calculations reflect the child's actual needs, parental ability to pay, and local living standards. For parents with fixed income, support is generally assessed at 20% to 30% of gross monthly income; for two or more children, the proportion may be raised, but typically does not exceed 50% of monthly income. For parents without fixed salaries, support is benchmarked against annual total earnings or local industry average wages using the same ratio. For example, on an 8,000 RMB monthly income, child support ranges from 1,600 to 2,400 RMB monthly. Child support is generally payable until the child reaches age 18. Even if a set amount is determined by agreement or court judgment, the child retains the statutory right to request reasonable additional expenses when necessary, such as catastrophic medical bills or necessary educational cost surges. Clauses agreeing that one parent pays zero child support are valid, but if the custodial parent's living standards drop substantially or the child's necessary expenses escalate, the child can still petition the court to mandate support payments. Unpaid arrears under a divorce agreement can be recovered via lawsuit and enforced via court asset seizure. For parents who refuse to assist in court-ordered visitation, courts can impose civil fines or judicial detention, but "cannot enforce compulsory execution on the person of the child or the act of visitation itself."
Conditions, limits and disagreements
The 20% to 30% guideline is a judicial benchmark for contested court rulings, not a statutory floor for agreements; parents remain free to mutually agree on other figures. When drafting a divorce settlement, clearly specify the payment calendar day, account number, end date, exact days of the week, handover hours, and vacation allocations to avoid post-divorce enforcement deadlocks. If a parent or relative forcibly abducts or hides a child, petition the court for a personal safety protection order as described in Chapter 8, Rule 43. Divorce procedures and statutory cooling-off periods are outlined in Chapter 10, Rule 15. The primary beneficiary is your child; the secondary beneficiary is yourself.
